Does the new student in my class have mental retardation?

have new student in class named pete. year younger me , 9th grader. school mixed academics, example 9th grader can placed 10th grader. in 10th grade. reasons why think pete might have mental retardation because runs before leaves class, says "**** you" time, pokes me , answers every question wrong. spits in school hallways too. can't stand having him in class , want him in lower class. never tease him have tell him stop. every time tell him stop says "**** you" or screeches in face. wonder disability is.
