because did not marry spencer family.

diana did not own spencer tiara , not bequeath anyone. belongs spencer estate , intended worn brides , wives of spencer men , daughters of such men. if can said own it, earl spencer does.

diana third daughter in immediate family. had no better claim on tiara 2 sisters did , less claim brother, inherited title , estate. tiara was, in fact, returned him.

edit: might add number of occasions on tiaras considered appropriate has diminished. duchess has had reason wear tiara once, on wedding day. if diana had been able leave spencer tiara william, wife has had, far, no occasion besides wedding on wear it.
