depends on jurisdiction, but...

if in public area, jurisdictions consider guilty if being done in public area in apartment. if in room door shut, you're ok. if sitting on couch , in chair in same room, guilty.

in situation once, played stupid , pretended had no idea friend smoking, told them thought shitty smelling pipe tobacco. got away it.

depends on state live in, in misdemeanor fine, in others possible imprisoned in cases cop wouldn't care unless there reason, might use tack on few more charges whatever there for.
depends on why cop came place, how wanted bust , state laws.

i live in canada , wondering can in trouble if you're people smoking not smoking yourself?
