Should I open a claim for this on Ebay?

bought second hand laptop off private seller , arrived poorly packaged. laptop in it's original box box lacked fixture inside have secured laptop during transit. know because have exact laptop myself brand new, , i'm buying second hand 1 of same young daughter use.

laptop bumping , sliding in cardboard box way through transit. bumping , sliding side side of box when postman delivered me , when carried home.

on opening inspection, laptop seemed undamaged superficially. screen, keys, etc. fine. charging , reinstallation of windows xp went okay. battery little bit used had half time left on when charged.

won't clear if internally had been damaged due poor packaging until passage of time. concerned about.

contents reeked badly of cigarette smoke. , mean it's bad. husband smokes , personal belongings don't stink badly this.

seller never mentioned of above faults in auction.
i'm wondering if should return outright , pay postage (plus bus far or 40 minute walk post office , back), or should ask partial reimbursement compensation poor packaging , smell?

laptop bought @ low price of £50. plus £12.99 postage , packing.(the postmark on package says postage cost £9.25 though, must have used £3 else)
